DUI 2nd within 1-5 years of a 1st Offense

 

DUI 2nd within 1-5 years of a DUI 1st offense, is punished more severely than a DUI 1st.  Like a DUI 1st, it is both a traffic and criminal offense.  It is punished as a class I misdemeanor, which means a Judge can give you a 2500 fine, up to one year in jail, and will be required to suspend your license for 3 years.  You will not be eligeable for a restricted license until after one year.  The minimum jail time for this offense is 20 days, and if your alcohol level was a .15 or above, it will require more than 20 days jail time.  Ignition interlock is also required.  The minimum fine is 500.00.  You will also be required to participate in the ASAP program.  

 

 

DUI 2nd within 5-10 years of  a first offense

 

DUI 2nd within 5-10 years is punished more severely than a DUI 1st offense.  Like a DUI 1st, it is both a traffoc and criminal offense.  It is punished as a Class I misdemeanor, which means that a Judge can sentence you up to a 2500 fine, up to one year in jail, and will be required to suspend your license for 3 years.  You will not be able to obtain a restricted license until after 4 months.  The minimum jail time for this offense is 10 days, and if your alcohol level was a .15 or above, it will require more than 10 days in jail.  Ignition interlock is also required for a minimum of 6 months.  The minimum fine is 500.00.  You will also be required to participate in the ASAP program.
